In the digital realm, individuals’ potentially infringing activities are often stored and transmitted via third-party networks. These include web hosting services, internet service providers, and search engines that link to online content. Under Section 512 of the Digital Millennium Copyright Act (DMCA), online service providers (OSPs) are shielded from liability for subscriber-posted or transmitted content, provided they promptly remove or disable access to material flagged in a copyright holder’s complaint.
To qualify for safe harbor protection, content-hosting service providers must:
- Have no knowledge of or financial benefit from infringing activity occurring on their network.
- Implement a copyright policy and notify their subscribers accordingly.
- Designate an agent to handle copyright complaints.
Although safe harbor provisions allow individuals to contest the removal of their materials after they’ve been taken down, service providers are not required to notify them before removing allegedly infringing content. If the material on your site does not infringe a copyright owner’s intellectual property rights and has been improperly removed, you may submit a counter-notice to the service provider. The service provider must then forward this to the complainant. If the copyright owner fails to notify the provider within 14 business days that they have filed a lawsuit, your content may be restored online.
